    PLEASE READ THIS DISCLAIMER CAREFULLY BEFORE REQUESTING SERVICES

    1. OUR ROLE AS A TECHNOLOGY PLATFORM

    1800AUTOTOW INC. ("1-800 AUTO TOW," "Company," "we," "us," or "our") operates as a technology platform only. We connect customers in need of roadside assistance with independent, third-party towing and roadside service providers ("Service Providers").

    WE DO NOT PROVIDE TOWING OR ROADSIDE ASSISTANCE SERVICES DIRECTLY. All physical services — including towing, tire changes, jump starts, lockout assistance, fuel delivery, and vehicle recovery — are performed exclusively by independent Service Providers who are not employees, agents, or representatives of 1-800 AUTO TOW.

    2. PAYMENT FOR SERVICES

    2.1 Direct Payment to Service Providers

    All payments for roadside assistance and towing services are made directly between you (the customer) and the Service Provider. 1-800 AUTO TOW does not collect, process, or handle payments for services rendered by Service Providers.

    2.2 Pricing

    You acknowledge and agree that:

    • Prices displayed on our Platform are estimates provided by Service Providers and may vary based on actual service requirements
    • Final pricing is determined solely by the Service Provider
    • Additional charges may apply for extended distance, difficult conditions, vehicle type, time of day, or additional services
    • You are responsible for confirming the final price with the Service Provider before services are rendered
    • 1-800 AUTO TOW has no control over and does not guarantee any pricing

    2.3 Payment Disputes

    Any disputes regarding payment, pricing, or charges must be resolved directly between you and the Service Provider. 1-800 AUTO TOW is not a party to any financial transaction between you and the Service Provider and cannot mediate, arbitrate, or resolve payment disputes.

    3. LIMITATION OF LIABILITY FOR SERVICE FEES

    1-800 AUTO TOW IS NOT RESPONSIBLE OR LIABLE FOR ANY FEES, CHARGES, OR PAYMENTS MADE TO SERVICE PROVIDERS

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1-800 AUTO TOW EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY FOR:

    • Service Fees: Any fees, charges, or amounts paid by you to Service Providers for towing or roadside assistance services
    • Price Discrepancies: Any difference between estimated prices displayed on the Platform and final charges assessed by Service Providers
    • Unauthorized Charges: Any charges imposed by Service Providers without your consent or beyond the agreed scope of services
    • Payment Processing: Any issues related to payment processing, including declined payments, fraud, or unauthorized transactions
    • Refunds: Any refunds or credits for services provided by Service Providers — all refund requests must be directed to the Service Provider
    • Quality of Service: The quality, safety, legality, or timeliness of services provided by Service Providers
    • Property Damage: Any damage to your vehicle or property caused by Service Providers during service delivery
    • Personal Injury: Any injuries sustained during service delivery by Service Providers

    4. YOUR ACKNOWLEDGMENT

    By using the 1-800 AUTO TOW platform, you expressly acknowledge and agree that:

    • You understand 1-800 AUTO TOW is a technology platform only and does not provide towing services
    • All service contracts are between you and the Service Provider directly
    • You are solely responsible for verifying pricing before services are performed
    • Payment disputes must be resolved directly with the Service Provider
    • 1-800 AUTO TOW has no obligation to refund, credit, or reimburse any fees paid to Service Providers
    • 1-800 AUTO TOW is not liable for any claims arising from services performed by Service Providers

    5. YOUR RECOURSE

    If you have issues with services provided or fees charged by a Service Provider, you should:

    • Contact the Service Provider directly — their contact information is provided in your service confirmation and receipt
    • Document any issues — take photos, save receipts, and record details of the dispute
    • Dispute charges with your payment provider — if you paid by credit card and believe charges were fraudulent or unauthorized
    • File a complaint with appropriate authorities — contact your state's consumer protection agency or attorney general's office if you believe you have been defrauded
    • Leave a review on our platform — your feedback helps other customers and helps us maintain quality standards for Service Providers

    6. REPORTING SERVICE PROVIDER ISSUES

    While 1-800 AUTO TOW is not responsible for Service Provider conduct or fees, we encourage you to report any issues so we can review Service Provider quality and take appropriate action, which may include removing Service Providers from our platform.

    Note: Reporting an issue to us does not create any obligation for 1-800 AUTO TOW to resolve your dispute with the Service Provider or provide any refund or compensation.

    7. INTEGRATION WITH TERMS OF SERVICE

    This Service Fee Disclaimer is incorporated into and forms part of our Terms of Service. In the event of any conflict between this Disclaimer and the Terms of Service, the Terms of Service shall control. By using our Platform, you agree to both this Disclaimer and the Terms of Service.
